My Neighbor's Tree Fell on My Property in Dallas — What Are My Rights?

It happens more often than you might think in Dallas: a storm rolls through, and you wake up to find your neighbor's tree on your fence, your car, or your roof. The first question everyone asks is: who is responsible?

The answer is more nuanced than most people expect — and it often surprises both parties.

Under Texas law, a property owner is generally not liable for damage caused by a healthy tree that falls due to an act of nature (storm, wind, lightning). If your neighbor's live oak falls on your fence during a thunderstorm, your homeowner's insurance covers your fence repair — not your neighbor's insurance.

This feels counterintuitive, but the legal reasoning is that a healthy tree falling in a storm is an unforeseeable event, and the property owner cannot be held liable for unforeseeable events.

The situation changes when negligence is involved. Your neighbor may be liable for damage caused by their tree if:

The tree was dead or visibly diseased. If the tree was clearly dead or in obvious decline before it fell, and your neighbor knew (or should have known) about the condition, they may be liable for failing to address a known hazard.

You gave written notice. If you sent your neighbor a written notice (letter, email, text) warning them that their tree was dead, diseased, or leaning dangerously, and they failed to act, that documentation significantly strengthens a negligence claim.

The tree was improperly maintained. If the tree was damaged by improper pruning or other negligent maintenance that contributed to the failure, liability may attach.

1. Document everything immediately. Photograph the fallen tree, the damage, and the tree's condition (dead wood, decay, obvious lean) before anything is moved.

2. Call your insurance company. File a claim under your own homeowner's policy. Your insurer will cover your damage (minus deductible) and may pursue your neighbor's insurer for reimbursement if negligence is involved.

3. Notify your neighbor in writing. Even after the fact, send a written notice documenting what happened and the damage caused. Keep a copy.

4. Consult an attorney if the damage is significant. For major damage — a tree through your roof, a totaled vehicle — consulting a property attorney about your options is worth the cost.

In Texas, you have the right to trim branches from a neighbor's tree that overhang your property, up to the property line. You can do this without your neighbor's permission. However:

• You cannot damage the tree in the process
• You are responsible for the cost of trimming
• You cannot enter your neighbor's property to do the trimming

If overhanging branches are dropping debris, blocking light, or creating a hazard, trimming them back to the property line is your right — and often the most practical solution.

The best approach is proactive communication. If you notice a neighbor's tree that looks dead, diseased, or structurally compromised, talk to them about it. A friendly conversation is almost always more effective than a legal dispute after the fact.
